How to buy at KUARTZ as a foreigner — and why freehold here is a fact, not a promise

The EIA register files KUARTZ as a condominium. That one line decides the ownership question before any brochure: foreign buyers can hold a chanote in their own name, within the 49% quota. Here is what that means and how the purchase goes.

Freehold or leasehold — and why the register entry settles it

Thailand's Condominium Act allows foreign nationals to own up to 49% of the total saleable area of a condominium building. Inside that quota ownership is direct: the chanote is issued in your name, and the apartment can be sold, inherited and mortgaged without a Thai partner and without a company.

The remaining 51% is sold to foreigners on leasehold only — normally a thirty-year registered lease with renewal terms in the contract. Leasehold works, and a good share of Phuket's supply is sold that way, but it resells at a discount and it is a different asset.

None of this applies to a building that is not a condominium: a residential building registered under the Building Control Act has no foreign quota at all, and foreigners buy there on lease. That is why the registry subtype is the first thing to check about any Phuket presale — and why for KUARTZ the question is already answered: the register lists it as a condominium.

How the purchase goes, step by step

The sequence Rhom Bho has used at its previous 14+ launches. KUARTZ amounts and dates arrive with the price list.

  1. 1. Register before the launchThe price list and the unit table go to registered buyers on launch day. Arriving with a shortlist of layouts beats negotiating afterwards.
  2. 2. Choose a unit and pay the reservationThe reservation holds a specific apartment for a set period. Read what happens to it if the project changes — a fair question while the EIA is under review.
  3. 3. Sign the sale and purchase agreementUsually within weeks of the reservation, with the first substantial instalment. This is the document to show your own lawyer, not the developer's.
  4. 4. Pay by the scheduleInstalments during construction. The completion date for KUARTZ has not been published; the schedule will be tied to it.
  5. 5. Bring the money from abroadIn foreign currency, into Thailand, converted here. Keep the bank documents: the Land Office needs them to register a foreign-quota purchase.
  6. 6. Accept the apartment and register the titleSnagging before signing, then registration at the Land Office, the transfer fee and the sinking fund.

Worth knowing

Three questions to ask in writing before paying

What happens to the reservation. The EIA is under review; for a 7-storey building of 189 units the review is routine, but ask what happens to your money if the timeline moves or the design changes, and have the answer written into the reservation agreement rather than a chat.

Which quota your unit is in. Two identical apartments on one floor can differ in one thing: one is inside the foreign freehold quota, the other is not, and that stays with the unit for its whole life. Ask about the specific unit number, in writing.

What a month will cost. The common-area fee is set per square metre and comes with the price list. Check it second, not last — it changes the rental arithmetic more than the purchase price does.

Questions from foreign buyers

Can I buy without coming to Thailand?

In practice yes — by power of attorney, with the funds transferred from abroad in your own name. It is common, and it is also the case where your own lawyer matters most.

Do I need a Thai bank account?

Not for the purchase. The foreign-currency transfer has to arrive and be converted in Thailand with the right paperwork. An account here makes paying bills easier once the apartment is yours.

Can I buy through a company?

A foreign-owned company does not get around the quota; a Thai company with nominee shareholders is the arrangement Thai authorities look for and unwind. At a condominium with a freehold quota there is no reason to go there: buy in your own name within the 49%.

What does freehold at KUARTZ give me in practice?

A chanote for the apartment in your own name, registered at the Land Office. You can sell it, leave it to your heirs or mortgage it without a Thai partner, a company or a lease to renew. On resale a freehold unit is priced above a leasehold one of the same size.

Will my apartment be inside the 49% quota?

The quota is 49% of the building's saleable area, and the developer allocates it unit by unit. Ask about the specific apartment number when you reserve — we get the answer in writing and it goes into the reservation agreement.
